These Terms & Conditions apply to all use of the website Cardotopia.com and to all orders placed through the website. By accessing the website or placing an order, the customer agrees to these Terms & Conditions.
Mandatory consumer rights under Belgian and EU law remain unaffected.

2. Scope and Applicability
These Terms & Conditions apply to:
- all offers, orders, and agreements concluded via Cardotopia.com;
- both consumers (B2C) and business customers (B2B), unless explicitly stated otherwise.
Any deviation from these Terms & Conditions is valid only if expressly agreed in writing by BTRT srl.
3. Products and Availability
3.1. Cardotopia.com sells trading card games, collectibles, accessories, and related products.
3.2. Product descriptions, images, and specifications are provided for informational purposes. Minor variations (including packaging variations) do not constitute non-conformity.
3.3. Availability is subject to stock. If a product is unavailable after an order is placed, Cardotopia.com will inform the customer and refund the corresponding amount without undue delay.
4. Pre-Orders
4.1. Pre-orders concern products not yet released or not yet available for immediate shipment.
4.2. Release dates are estimates provided by manufacturers or distributors and may change. Delays do not give rise to compensation beyond statutory rights.
4.3. Pre-orders are final and cannot be voluntarily cancelled by the customer once placed, without prejudice to mandatory legal rights after delivery.
5. Prices
5.1. All prices are displayed in EUR (€) and include VAT unless stated otherwise.
5.2. Shipping costs are shown separately before the order is finalized.
5.3. Cardotopia.com reserves the right to correct pricing errors at any time. If an obvious pricing error occurs, Cardotopia.com may cancel the order and refund any payment made.
6. Orders and Contract Formation
6.1. An order becomes binding once the customer completes the checkout process and payment is received.
6.2. Cardotopia.com reserves the right to refuse or cancel an order in case of:
- suspected fraud or abuse,
- incorrect pricing or product information,
- stock unavailability,
- incomplete or incorrect customer information.
7. Payment
7.1. Payment must be made using the payment methods offered at checkout.
7.2. Orders are processed only after full payment has been received.
7.3. In case of non-payment or payment reversal, Cardotopia.com reserves the right to suspend or cancel the order.
8. Delivery
8.1. Orders are shipped from Belgium.
8.2. Delivery times are indicative and not guaranteed. Delays do not automatically entitle the customer to compensation.
8.3. Risk of loss or damage passes to the customer at the moment of delivery to the customer or their designated recipient.
8.4. The customer is responsible for providing a correct delivery address. Additional costs resulting from incorrect address details may be charged to the customer.
9. Right of Withdrawal and Returns
9.1. Consumers have a statutory right of withdrawal as described in the Return, Withdrawal & Refund Policy published on Cardotopia.com.
9.2. Conditions, exclusions, deadlines, and procedures for returns and refunds are governed exclusively by that policy, which forms an integral part of these Terms & Conditions.
10. Exclusions and Product-Specific Rules
10.1. Certain products are excluded from return or withdrawal where permitted by law, including but not limited to:
- single trading cards,
- pre-orders,
- opened or tampered products,
- digital goods and gift cards,
- mystery products,
- custom-made goods,
- sale or clearance items.
10.2. Due to the collectible nature of trading card products, condition sensitivity applies. Any change in condition may result in diminished value or refusal of refund, as detailed in the Return Policy.
11. Complaints and Conformity
11.1. The customer must inspect the goods upon delivery.
11.2. Complaints regarding damaged, defective, or incorrect items should be reported as soon as possible and preferably within 48 hours of delivery, with supporting evidence.
11.3. In case of proven non-conformity, the customer is entitled to the remedies provided by mandatory law.
12. Liability
12.1. Cardotopia.com is not liable for indirect or consequential damages, including but not limited to loss of profit, loss of data, or loss of collectible value.
12.2. Liability is limited to the purchase price of the product concerned, except where mandatory law requires otherwise.
12.3. Nothing in these Terms & Conditions excludes or limits liability in cases of fraud, willful misconduct, or where exclusion is not permitted by law.
13. Force Majeure
Cardotopia.com is not liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, strikes, transport disruptions, supplier failures, or governmental measures.
14. Intellectual Property
All content on Cardotopia.com, including texts, images, logos, product descriptions, and layout, is the intellectual property of BTRT srl or its licensors and may not be used without prior written consent.
15. Account Use
15.1. Customers are responsible for maintaining the confidentiality of their account credentials.
15.2. Cardotopia.com may suspend or terminate accounts in case of misuse, fraud, or violation of these Terms & Conditions.
16. B2B Customers
Business customers do not benefit from the consumer right of withdrawal. Returns or cancellations for B2B orders are only possible with prior written agreement from Cardotopia.com.
17. Governing Law and Jurisdiction
These Terms & Conditions are governed by Belgian law.
Any disputes shall fall under the exclusive jurisdiction of the court of Liège, Belgium, without prejudice to mandatory consumer jurisdiction rules.
18. Amendments
Cardotopia.com reserves the right to amend these Terms & Conditions at any time. The version applicable is the one in force at the time of the order.
19. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions remain fully in force.
